1.2 Information from Apple HealthKit
With your explicit permission, we may read the following data from Apple HealthKit:
- Activity Data: Step count, active energy burned, exercise minutes, workout data
- Body Measurements: Body weight, body fat percentage, height
- Vitals: Resting heart rate, heart rate variability, blood oxygen saturation
- Nutrition: Dietary water, caffeine intake
- Sleep: Sleep duration and sleep analysis
Important: We only read data from HealthKit; we do not write data to HealthKit. HealthKit permissions are optional and can be revoked at any time. We will NEVER use HealthKit data for advertising, marketing, or data mining purposes.
1.3 Information Collected Automatically
Device Information: Device type and model, operating system version, unique device identifiers, app version.
Usage Information: Features you use and actions you take, time, frequency, and duration of activities, screens viewed and navigation patterns, performance data and crash reports.
Log Data: IP address, access times and dates, error logs and diagnostics.
1.4 Information from Third-Party Services
If you sign in using Google or Apple Sign-In, we receive your name (as provided by the service), email address, and unique identifier from the authentication provider. We do not receive or store your passwords from these services.

5. Apple HealthKit Data
5.1 Special Protections for HealthKit Data
- Read-Only Access: We only read data from HealthKit; we do not write to HealthKit
- No Advertising Use: HealthKit data is NEVER used for advertising or marketing
- No Data Mining: HealthKit data is NEVER used for data mining
- No Unauthorized Sharing: HealthKit data is NEVER shared with third parties for their own purposes
5.2 Your Control Over HealthKit Data
- You choose which HealthKit data types to share with PeakMacro
- You can revoke HealthKit permissions at any time in your device Settings
- Revoking permissions stops future data syncing but does not automatically delete previously synced data
- You can delete previously synced HealthKit data by deleting your account
6. AI Features and Data Processing
6.1 How AI Features Work
- Your input (text description, voice input, or photo) is sent to OpenAI's servers
- OpenAI processes the input and returns nutritional analysis
- The results are displayed in the App and saved to your nutrition log
- OpenAI does not retain your data for training purposes
6.2 AI Data Processing Disclosure
Data sent to AI services may include: Meal descriptions you type or speak, photos of meals you upload, context about your recent meals (to improve accuracy).
Data NOT sent to AI services: Your account information (name, email), your complete nutrition history, your HealthKit data, your personal health goals or body measurements.
6.3 AI Limitations
AI-generated nutritional estimates are approximations and may contain errors. See our Terms of Service for important disclaimers about AI features.
7. Data Retention

10. HIPAA and Health Data Classification
Peak Macro LLC is not a "covered entity" or "business associate" as defined under HIPAA. PeakMacro is a direct-to-consumer wellness application. Your nutrition, fitness, and health information is considered "consumer health data" under applicable state laws, not "Protected Health Information" (PHI) under HIPAA.
Your health data is protected by state consumer privacy laws (CCPA/CPRA, VCDPA, etc.), Washington's My Health My Data Act, Apple's HealthKit Guidelines, and our privacy practices including encryption and limited access.
11. Tracking Technologies and Cookies
Mobile App Tracking: We may use analytics tools to understand how users interact with the App. Analytics data is anonymized and does not include your nutrition logs or health data. We do not display third-party advertisements or use advertising identifiers for ad targeting.
Website: Our website may use essential cookies for functionality and security, and analytics cookies to understand website traffic. We do not use cookies for targeted advertising.
12. Children's Privacy
PeakMacro is not intended for use by anyone under 18 years of age. We do not knowingly collect personal information from children under 18. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately at bryan@peakmacro.com.
13. International Data Transfers
Your personal information is processed and stored in the United States. PeakMacro is currently offered only in the United States. If you access the Service from outside the United States, you do so at your own risk.

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies before providing any information.
